Kuwait Court of Cassation principle number 3958

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A defense not resting on a sound factual and legal basis. The judgment need not respond to it. - The provision in Article 297 of Procedure requiring service of the travel ban order upon the person against whom it was issued within two weeks of its issuance. Its meaning. Affording that person an opportunity to challenge it in ample time before his travel or to settle with the creditor, because the ban procedures take place in the debtor’s absence. The creditor’s failure to serve the debtor within that period. Does not entail lapse or invalidity of the order. Failure to respond to the defense that the travel ban order lapsed because it was not served upon the person against whom it was issued within two weeks of its issuance. Does not vitiate the judgment. Reason therefor. Example.
