Taking into account any pension or gratuity granted to the injured party when assessing compensation. Has no place unless it was granted exceptionally on account of the damage that is the subject of compensation. The wife's failure to invoke the exceptional grant of a pension on account of the damage for which compensation is sought. Her defence relating thereto. Unavailing, so the judgment is not required to investigate it.

مراعاة ما يكون قد تقرر للمضرور من معاش أو مكافأة عند تقدير التعويض. لا محل له ما لم يكن قد تقرر بصفة استثنائية بمناسبة الضرر موضوع التعويض. عدم تحدي الزوجة بتقرير معاش بصفة استثنائية بمناسبة الضرر المطالب بالتعويض عنه. دفاعها المتعلق بذلك. غير منتج فلا يلزم الحكم تحقيقه.Original Arabic judgment citations
