The ordinary method of instituting an action is to deposit its statement of claim with the court registry. Its effect. Commencement of proceedings. The proceedings remain pending until the adversarial principle is fulfilled by valid service thereof. Failure of service. Its effect. Extinction of the proceedings. This is not altered by the defendant or his representative attending the hearing without service. The same rule applies to appeal proceedings.
