Kuwait Court of Cassation principle number 4266

Formal pleas unrelated to public policy. They must be raised together and before any other procedural plea, application or defence in the action, and must be asserted in the appeal petition, otherwise the right to them is forfeited. Such forfeiture does not apply where the right to raise the plea arose only after the petition was filed.
