Kuwait Court of Cassation principle number 4298

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The criterion for determining that a payment was not due is to view it from the recipient's perspective, not the payer's. - An action for restitution of a payment not due is time-barred upon the lapse of three years from the day the claimant becomes aware of his right to restitution, or fifteen years from the day this right arises.
