Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4400

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The defendant's name appearing in the wording of the action alone, without mention of his capacity as agent. Does not give rise to the right to plead inadmissibility of the action for being brought against a person without standing, so long as he was joined in the action in that capacity and the action was originally directed against the person personally liable for the subject matter of the claim.
