English translation of the principle

Prohibiting the judge from hearing an action merely upon expiry of the period prescribed for hearing it. Refers to the ruler's authority to delimit adjudication by time, place and dispute. Its implication. Lapse of time does not invalidate the right. The implication thereof: a party's acknowledgment of the right claimed, despite lapse of time, is binding upon that party. - The acknowledgment of a right which precludes a plea that the action may not be heard. It is an acknowledgment that the right claimed remains currently owed. The implication thereof: recognition of the original right while claiming discharge of - 815 - Civil Procedure liability does not constitute acknowledgment of the right. - The right claimed in an action for partial rescission and compensation for the seller's breach of its obligation to transfer ownership of part of the divisible thing sold to the purchaser because the seller does not own that part. It is the right to partial rescission of the contract and the right to compensation arising from breach of that obligation. Its implication. The acknowledgment which precludes the defendant from pleading that such an action may not be heard is its acknowledgment of the claimant's right to rescission and compensation. Failure to acknowledge the right in that manner. Its effect. The judge is barred from hearing the action whenever the conditions for its application are met. This is not altered by whether the denying party is correct or mistaken in its acknowledgment. The basis thereof. - Barring the judge from hearing the action owing to lapse of time. Rests on mere denial without examining whether it is correct or mistaken. The rationale. - Denial requiring that the action not be heard. Applies to all personal rights, whatever their type, so long as the period barring the hearing of an action concerning them has elapsed. Its effect. Its application to an action for rescission for breach of the obligation to transfer ownership of the thing sold to the seller. Article 438 of the Civil Code. - Plea of inadmissibility of the action:-
