Kuwait Court of Cassation principle number 495
State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
A claim for a judgment declaring the validity and enforceability of a sale contract. Its difference, in subject matter and cause, from a claim for a judgment confirming ownership by acquisitive possession. The former is based on an unregistered sale contract to obtain a judgment whose registration takes the place of registration of the contract in transferring ownership. The latter is based on possession as a means of acquiring ownership to obtain a judgment declaring that ownership is established. - An action for the validity of a contract. Not one of the indivisible actions. The condition for that.
