Kuwait Court of Cassation principle number 496
State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The legislature surrounded expropriation procedures with sufficient safeguards to achieve the public interest and preserve the rights of owners of properties subject to those procedures. Valuation of the property is undertaken only after the expropriation decision has been issued and published in the Official Gazette and the Real Estate Registration Department has been notified by a copy thereof. Completion of these procedures removes the property from the sphere of transactions, and it is deemed public property of the State; rights in rem over the property transfer to the corresponding compensation amount. Article 33 of Law 33 of 1994. Example - Registration of a gift contract:-
