State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Definition of mental infirmity under Article 945 of the Majalla and the statements of the jurists. Assessment of the existence of mental infirmity. A matter for the court of merits. The disposition of a mentally infirm person is like that of a discerning minor; permission is not given by anyone other than the guardian. The Majalla does not require mental infirmity to be commonly known before registration of the interdiction decision or require the other contracting party’s knowledge.
