English translation of the principle

A minor lacking discernment is subject to guardianship over the person, beginning with his father, even if he is in the custody of his divorced mother. The reason therefor. The father is his legal representative, and that of a discerning minor who has not attained majority, within the meaning of Article 10 of the Passports Law. The provision extends to a person lacking legal capacity because the rationale is the same.
