Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 799

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Standing to appeal. It belongs to the litigant, not his representative, since the action is the litigant's action and not his representative's. Example: issuance of the first-instance judgment against the Minister of Education in his official capacity. The ministry's undersecretary, in his capacity, may appeal it. The reason for this: the minister may entrust some of his powers to the ministry's undersecretary.
