Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 830

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Standing in proceedings. It is established for the person who was a party, not for his representative in the proceedings in which the judgment was rendered. The reason thereof. The action is not his own but that of the person he represents, and the criterion for identifying the party is the reality presented in the action. - The judgment's stating the agent's name as the party without accompanying it with the expression "in his capacity." A clerical error of expression that neither obscures nor casts doubt on the identity of the actual party and his connection to the proceedings, and does not in itself constitute a ground for cassation appeal. A challenge on this ground. Inadmissible.
