Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 861

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Determination of the existence of standing in an action. A question of fact solely for the judge of merits. It suffices that he state the truth of which he is persuaded and base his ruling on reasons sufficient to support it. - The relationship of parties with their agents. The court may not address it unless the person concerned denies his agent’s authority. No one other than the principal may object that the procedural act undertaken by the agent falls outside the scope of his authority. The rationale therefor. Example concerning the court’s not addressing the agency relationship between the respondent and his principal and what the appellant raised, namely that his authority did not permit him to bring the action, since that is the principal’s concern and not hers.
