Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 921

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The interest required for the admissibility of an action or application. Its nature. It makes no difference whether the interest is material, moral or serious. A potential interest suffices, even if it is a semblance of a right, where the purpose of the application is to take precautions to avert imminent harm or to secure evidence of a right whose proof is feared to disappear when a dispute arises. Contravention of this. An error requiring cassation of the judgment. Example concerning an action seeking delivery of documents attached to an expert report.
