English translation of the principle

The judge's obligation to refrain from hearing the action. Its basis. His performance of an act that gives him an opinion on it inconsistent with the requirement that his mind be free of its subject matter. - The judge's prior consideration of the action that prevents him from reconsidering it. What is meant thereby. His previous issuance of a dispositive judgment or an interlocutory judgment on part thereof, or his taking a procedural step therein revealing his opinion or viewpoint. An example of the absence of the impediment. - The judge's previous issuance of a judgment appointing an expert to investigate a defence in the action without going beyond that to express an opinion on the merits of the dispute. Does not constitute a ground for disqualification. The consequence thereof. An action seeking the nullity of a judgment subsequently rendered by him on the merits is unfounded.
