Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 134

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that a lawyer is an agent whose relationship with his client is governed by the general law provisions concerning the relationship between principal and agent. The provision in Article 32 of Law 42 of 1964 concerning the legal profession empowering the judge to assess the lawyer’s fees if the client disputes them. The amendment of that Article by Law 62 of 1996 and the removal of the former provision concerning assessment of lawyers’ fees where disputed mean that the legislature intended thereby to leave this matter to the provisions of general law, namely the Civil Code provisions on agency, because there is no conflict. An example. - 28 - Civil Procedure
