Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1379

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The reasons of a judgment. The criterion for considering them tainted by faulty inference. - The judgment's conclusion to reject the certificate of the General Department of Criminal Evidence containing the police station's statement that the vehicle involved in the accident was the one that ran over the female appellant's predecessor in title, on the assertion that its authors had not themselves witnessed the particulars it contained but that the person concerned had related them to them, and its consequent finding that it was untrue, although the police station reported this on the basis of the record it had drawn up based on its investigations. This taints the judgment with faulty inference and requires its cassation.
