Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1394

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Unsound inference in a judgment. Its condition. That its reasons be tainted by a defect affecting the soundness of the deduction. This occurs where the court bases its conviction on evidence objectively unfit to support that conviction, on a failure to understand the factual elements established before it, or on a contradiction between those elements. - The two respondents’ failure to submit anything supporting their plea, and the court’s acceptance of it based on evidence unfit for that purpose. This taints the judgment with unsound inference and requires its cassation. - 219 - Procedure
