Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1463

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that a judgment must itself contain all its reasons and must not refer to the reasons of another judgment unless that judgment was previously rendered between the same parties, was deposited in the case file and became a document therein, and the parties contested its significance. This is not altered by the fact that the judgment referred to was rendered by the same court, on the same day, and in a case between the same parties. - A judgment’s reliance on another judgment rendered between the same parties and at the same hearing without an order having been issued to join them. Vitiates it through infringement of the right of defense.
