Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1607

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Cassation of a judgment extends only to what is covered by the accepted grounds of challenge. Everything else acquires the force of res judicata. The Court of Cassation may not reconsider it even if it concerns public policy. The reason for this. The force of res judicata prevails over public policy.
