Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1645

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judgments rendered by courts of second instance may be challenged by a petition for reconsideration. Their susceptibility to cassation appeal, or their actually being challenged thereby, does not preclude challenging them by such a petition. A litigant joined for confrontation is barred from again disputing what the judgment decided if it becomes final after becoming binding upon him, so long as he maintained a passive position in the proceedings without any impediment preventing him from acting. Example of a reasonable inference consistent with the law concerning application of res judicata pursuant to the challenged judgment on a petition for reconsideration in a nationality matter.
