State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The plea of inadmissibility of the action prescribed in Article 1 of Law No. 33 of 2000 concerning claims to ownership of State real estate does not relate to the validity of the proceedings. The court of first instance exhausts its jurisdiction by deciding it, as with defenses relating to the substantive right. The Court of Appeal's setting aside the judgment upholding it. It must proceed to determine the merits of the action.
