Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1751

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Contesting claims directed against the estate through the heirs. Is indivisible. Its implication. It suffices for some to raise the defense for the others to benefit from it, since the person raising it is deemed to represent the remainder, who thus benefit from it. Example: an appeal by one heir and not the others is deemed to have been brought by them as well.
