English translation of the principle

Indivisibility. Its meaning. That adjudication of the dispute admits of only one solution. A judgment deeming the appeal as never having been brought—in this case—in favour of the person who pleaded it entails deeming it as never having been brought with respect to the remaining respondents. - A request for judgment compelling the general partners to pay the amount jointly and severally among themselves. An indivisible subject matter. Deeming the appeal as never having been brought with respect to a person not served with its statement within the statutory time limit. Its effect. Deeming it likewise with respect to the others who were served with it. The reason for this.
