Kuwait Court of Cassation principle number 1853

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The parties may challenge by cassation any final judgment that determined a dispute contrary to another judgment previously rendered between the same parties and having acquired the force of res judicata. The determining factor is the identity of the dispute determined by the second judgment in a contrary manner.
