Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1917

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judgments rendered during the course of the action by which the proceedings do not terminate except after issuance of the judgment terminating the entire proceedings. May not be challenged independently. The reason for this. Preventing the fragmentation of a single case and its distribution among the various levels of courts, because this impedes determination of the merits of the action and increases litigation expenses, in addition to conflicting judgments. The exception. Provisional or urgent judgments, judgments staying the action and judgments susceptible to compulsory enforcement. May be challenged independently.
