Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1954

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Challenging a judgment by an independent nullity action. The general rule is that it is impermissible. The rationale for this. The legislature - 317 - Procedure exhaustively prescribed the methods of challenging judgments and laid down specified time limits and particular procedures for them. The exception. If a challenge is impermissible or has become closed, there is no means of setting the judgment at naught except by an independent nullity action.
