Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1961

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The relative effect of procedural acts. Its implication is that only a person who brought a challenge within the time limit benefits from it, and it may be invoked only against a person against whom it was brought within the time limit. - Actions whose subject matter is indivisible or is a joint and several obligation, or in which the law requires the joinder of particular persons. Multiple parties against whom judgment was rendered in any such action, with only one or some of them challenging the judgment within the time limit, while the time limit expired for the others or they accepted the judgment. They may nevertheless join the appellant in his challenge. Brought within the time limit; if they do not do so, the court must order the appellant to join them. The rationale for this exception. This rule applies to a joint and several obligation even if its subject matter is divisible.
