English translation of the principle

Commencement of the time limit for challenging a judgment. The general rule is from the date the judgment is rendered. The exception. From the date of service of the judgment. The excepted cases. These include where the judgment debtor fails to attend all hearings without submitting a memorandum of defence, and where that party fails to attend and to submit a memorandum of defence at all hearings following the resumption of the action after its sequential progress has ceased. - Disruption of the progress of the action and interruption of the sequence of its hearings without the judgment debtor attending or submitting a memorandum of defence. The time limit for challenging the judgment does not begin for that party until the date of service of the judgment. Example concerning a stay of proceedings and disruption of the sequence of hearings due to striking out, and commencement of the time limit from the date of service.
