Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2225

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Non-existence of a judgment. It occurs only if it is stripped of one of its essential elements, such as being issued by an improperly constituted court or by a person who is not considered a judge. - The concept of nullity differs from non-existence. The effect of the former is to preclude examination of the defects affecting it except by seeking redress against it through the appropriate means of challenge. - The Public Prosecution may apply for a declaration of bankruptcy of a deceased customer at any time if he had ceased paying his indebtedness purchased by the State or his heirs ceased paying it from his estate after his death. The action for a declaration of bankruptcy may, in this case, be served on the heirs collectively or on one of them in his capacity as representative of the deceased's estate. The basis for this.
