Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2265

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The Court of Appeal may of its own motion rectify material errors in the appealed judgment and rule in accordance with the correct position. The Court of Appeal's statement that the court of first instance could have made the correction. A superfluous digression without which the judgment stands.
