Kuwait Court of Cassation principle number 2325

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court of first instance's exhaustion of its jurisdiction through a judgment found to be void for a defect not extending to the statement of claim by which the litigation was validly constituted. The Court of Appeal must not stop at declaring nullity. It must proceed to determine the merits of the action by a new judgment observing the correct procedure.
