Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2348

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The binding authority of a judgment. It attaches to what the court has adjudicated expressly or implicitly, whether in the operative part or the reasons connected with it. Matters not actually examined by the court. They may not be the subject of a judgment possessing the force of res judicata, and the court does not exhaust its authority to adjudicate them. - A judgment that did not decide the question of the appellant’s entitlement to compensation for overtime hours. It does not exhaust the court’s authority to examine that question. Addressing that question anew and adjudicating it. This does not vitiate it.
