Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2361

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court's determination of one of the issues before it. Its effect. Termination of its jurisdiction in respect thereof. It must abide by what it has adjudicated when addressing the remaining issues before it in the action. This is not altered by whether or not the judgment rendered on that issue is independently appealable. An example concerning rejection of a plea of unconstitutionality.
