Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2369

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Nullity of the appealed judgment for a defect in it or in the proceedings preceding it, without the nullity extending to the statement of claim. The court must not stop at declaring nullity and must determine the merits by a new judgment observing the proper procedures. This is not considered deprivation of a level of litigation.
