State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court’s complete omission of some substantive claims. The remedy for that. - A cassation appeal against a judgment because it omitted a substantive claim. Impermissible. - A judgment’s determination of claims may be express or implied. The phrase “and dismissed all other claims” appearing in the operative part of the judgment. Its meaning: it does not constitute an adjudication in the dispute that extends beyond the claims examined in the judgment and does not extend to matters that the court did not address expressly or implicitly. An example of omission of a claim for interest that does not constitute a valid ground of appeal.
