Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2464

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An appeal transfers the action to the second-instance court only in respect of the matters appealed. - The determining factor in identifying a party’s claims is the relief he requests to be awarded, not what appears in the body of the statement of claim. Example. - A claim adjudicated by the first-instance court and not submitted to the Court of Appeal acquires the force of res judicata, which prevails over rules of public policy. - 412 - Civil Procedure.
