Kuwait Court of Cassation principle number 2466

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A judicial claim. A procedural act directed to the court against the opposing party, whereby the scope of the action is defined. The court must adhere to that scope when determining the action. - Inadmissibility of new claims on appeal. The basis may be changed while the original claim remains unchanged. An example concerning equivalent performance. - An award of equivalent performance or compensation resulting from unjust enrichment. Its foundation in the rules of tort liability, not the void contract. It involves a change in the cause of action, not a change in its subject matter.
