Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2513

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The judgment's disregard of the documents submitted by the female appellant to demonstrate the respondent's certain knowledge of the appealed judgment before filing the appeal. It is not defective on that account, this being a manifestly invalid defense. - No other means, even if conclusive, substitutes for service of the judgment on the judgment debtor. The rationale for this. The necessity of complete knowledge of all parts of the judgment.
