State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The respondent's failure to state his original domicile in his statement of claim before the court of first instance, without that domicile appearing in the case papers. Its effect. The statement of appeal may be served at his last elected domicile. Failure to complete that service within the prescribed period. Such delay is not deemed attributable to the appellant's act. Rejection of the plea that the appeal be deemed never to have existed. No defect.
