Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2643

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Complete omission to decide some claims through inadvertence or error. Its remedy is to return to the same court that omitted them, not to challenge the judgment. The Court of Appeal's failure to address the claim omitted by the court of first instance. No deficiency.
