Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2644

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court’s complete inadvertent omission to determine some claims. The remedy is to return to the same court, not to challenge the judgment. - Appealing a first-instance judgment for its omission to determine maintenance. Impermissible. The appellate judgment’s reaching this conclusion does not lead to its cassation, even if it erred in stating that the maintenance claim on appeal is a new claim. The Court of Cassation may correct the error without our quashing the judgment.
