Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2662

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Omission to determine some claims that permits the interested party to return to the same court for their determination. Its condition is that the omission results from inadvertence or mistake. However, if the judgment indicates an express or implied ruling dismissing the claim, the means of seeking redress against it is to challenge the judgment by the appropriate route, if it is open to such challenge. An example of a judgment ruling that an appeal is impermissible because of omission to determine the claim, although the ruling on it was dismissal. An error.
