Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2841

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An appeal transfers the action to the court of second instance only with respect to what has been appealed. - The determining factor in identifying a party's claims is the relief he requests to be adjudged in his favor, not what appears in the body of the statement of claim. Example. - A claim decided by the court of first instance and not submitted to the Court of Appeal. Acquires the force of res judicata, which prevails over rules of public policy.
