Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2881

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A judgment declaring an application to intervene inadmissible does not make the applicant a party to the action or to the judgment rendered therein, and the applicant has no right to challenge that judgment. The applicant is considered a party against whom judgment has been rendered on the application to intervene and may appeal the judgment declaring the intervention inadmissible.
Arabic original
