State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An appeal transfers the action to the Court of Appeal with its factual elements and legal evidence, within the limits of what is appealed. - The court may not worsen the challenger's position through a challenge filed by that challenger alone. Both the party in whose favour judgment was rendered and the party against whom it was rendered appealing the judgment between them. The court may affirm, set aside or vary the judgment, even if this harms one of them. - A claim for rent for a specified period and rent accruing thereafter until complete vacation. Its meaning. A claim for rent accruing after judgment in the action is considered to be before the Court of Appeal, which may award it if any has accrued. This does not constitute a worsening of the appellant's position. Example.
