English translation of the principle

The Court of Cassation may, of its own motion, raise grounds pertaining to public policy even if they were not set out in the cassation petition. - Inadmissibility of new claims on appeal. Its purpose. To avert the loss of one of the two levels of litigation. This pertains to public policy. - The appellant’s request in the first-instance statement of claim for the appointment of an expert as a preliminary step to seeking a judgment declaring him free of liability for the debt. Does not constitute a request by him for a judgment declaring him free of liability for that debt. Requesting this for the first time in the appeal petition. Constitutes a new claim. The Court of Appeal may not undertake to adjudicate it. A judgment taking a contrary course. A violation of the law requiring its cassation.
