Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3234

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Deeming the action or appeal as never having been brought. Discretionary for the court. Its condition. That the delay in service, whether intentional or negligent, is attributable to the plaintiff's or appellant's act, even if the petition was delivered by the registry to the process server. The reason therefor: the burden of continuously following up the procedures of his action or appeal and taking appropriate action if he observes delay in effecting service rests upon him, and his act need not be the sole, direct or principal cause. An example of delay. - The judgment's conclusion upholding a procedural plea. It is not blameworthy for not addressing the remaining defenses and pleas.
