Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3279

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Proceedings in an action or appeal must be resumed, where a stay has been ordered as a sanction, within thirty days of the expiry of the stay period. The reason therefor: expediting the pursuit of the proceedings without delay by serving the other litigant within the stated time limit as a condition for constitution of the proceedings against him. Submitting the pleading for reinstatement to the court registry. Insufficient. Expiry of the time limit. Its effect: a ruling deeming the action never to have been instituted is mandatory, unless the defendant or respondent objects. An example.
